1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and TRUVMail ("we," "us," "our," or "the Platform"), operated under TechTruv.

By registering for, accessing, or using TRUVMail (https://truvmail.techtruv.com), configuring mail sender profiles, linking third-party authentication (such as Google OAuth), or dispatching campaigns, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Description of Service

TRUVMail provides an online bulk email marketing, scheduling, and campaign dispatching platform. Key capabilities include:

• Creating, editing, and scheduling mass email campaigns.
• Importing, parsing, and managing recipient email lists (e.g. CSV format).
• Configuring custom SMTP sender profiles and authorized Google OAuth / Gmail API accounts.
• Generating real-time delivery, open tracking, and link click engagement analytics.

3. User Accounts & Google Authentication

To access TRUVMail features, you must register for an account using Google OAuth or designated login credentials.

• Accuracy of Information: You agree to provide accurate and complete account information.
• Account Responsibility: You are responsible for maintaining the confidentiality of your credentials and all activities that occur under your account.
• Google Authentication: When you connect your Google Account, you grant TRUVMail permission to access your profile identity and authorize outbound message sending via the Gmail API strictly for campaign dispatch as described in our Privacy Policy.
• Revocation: You can disconnect your Google sender accounts inside TRUVMail settings or revoke permissions at any time via Google Account Security Settings.

4. Acceptable Use & Anti-Spam Policy

By using TRUVMail, you represent and warrant that:

1. Permission-Based Lists: All recipient email addresses were collected through opt-in, consent-based, or legitimate commercial relationships. Purchasing, renting, or scraping email lists without explicit consent is strictly prohibited.
2. Accurate Headers & Sender Info: You will not use misleading headers, deceptive subject lines, or forged sender domains.
3. Unsubscribe Mechanism: All marketing emails sent through TRUVMail must include a functional, clearly visible unsubscribe mechanism, and you must honor opt-out requests promptly.
4. Prohibited Content: You will not distribute malware, phishing campaigns, deceptive financial schemes, illicit goods, or defamatory/hateful material.

Violation of this Anti-Spam Policy will result in immediate suspension or termination of your account without refund.

5. Third-Party Services & Google APIs

TRUVMail integrates with third-party service providers, including Google APIs.

• Compliance with Google Terms: Your use of Google integrations must comply with the Google Terms of Service.
• Google API User Data Policy: TRUVMail's handling of data received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.
• Third-Party Outages: We are not responsible for delays, service disruptions, or rate limiting caused by external SMTP relays, network providers, or Google API quotas.

6. Subscription Plans, Quotas & Payments

TRUVMail offers both free tier quotas and premium tiered subscription plans (Starter, Professional, and Enterprise):

• Quotas & Limits: Each plan specifies maximum email dispatch quotas, active sender accounts, and feature access. Usage in excess of your active plan limit may be throttled or paused until upgraded or renewed.
• Billing Cycles: Paid subscriptions are billed in advance on a monthly or annual basis depending on your selected tier.
• Cancellation: You may cancel or change your subscription plan at any time through your billing settings.
• Refund Policy: Except where required by applicable consumer protection laws, subscription fees are non-refundable once the billing period has commenced.

7. Intellectual Property & Content Ownership

• Your Content: You retain full ownership and intellectual property rights in the email content, graphics, templates, and recipient contact lists you upload to TRUVMail. You grant TRUVMail a limited license solely to process and dispatch your content as instructed by you.
• TRUVMail Property: TRUVMail, its software codebase, algorithms, trademarks, user interfaces, and documentation remain the exclusive property of TechTruv.

8. Deliverability & Warranty Disclaimers

TRUVMail provides tools to optimize campaign sending and deliverability analytics; however:

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TRUVMAIL, TECHTRUV, OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA LOSS, BLACKLISTING, OR BUSINESS INTERRUPTION) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10. Termination & Suspension

We reserve the right to suspend or terminate your account immediately, without prior notice or liability, if:

• You breach any provision of these Terms or the Anti-Spam Policy.
• Your account generates excessive bounce rates, spam complaints, or abuse reports.
• Required by law, law enforcement, or Google API policy enforcement.

Upon termination, your right to use TRUVMail will cease immediately.

11. Governing Law & Modifications

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which TechTruv operates, without regard to its conflict of law principles.

We reserve the right to modify these Terms at any time. We will provide notice of significant updates by revising the "Last Updated" date at the top of this page. Your continued use of TRUVMail after changes become effective signifies your acceptance of the updated Terms.
